By downloading, registering for, or using the FenceSpace mobile application and related services (the “Platform”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree to these Terms, please do not use FenceSpace. These Terms constitute a legally binding agreement between you and FenceSpace.
You must be at least 18 years of age to use FenceSpace. By using the Platform, you represent and warrant that you meet this age requirement, that you have the legal capacity to enter into a binding contract, and that your use of FenceSpace complies with all applicable laws and regulations in your jurisdiction.
3.1 Roles
FenceSpace supports two primary user roles:
3.2 Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at support@fencespace.app of any unauthorized access to or use of your account.
3.3 Accurate Information
You agree to provide accurate, current, and complete information during registration and to keep your profile and listing information up to date. FenceSpace reserves the right to suspend or terminate accounts with inaccurate, misleading, or fraudulent information.
4.1 Fence Owners agree that all listing information, including photos, dimensions, materials, location, pricing, and availability, is accurate and truthful.
4.2 Exact addresses will not be disclosed to Advertisers until a booking is confirmed. Owners are responsible for ensuring their fence is legally available for advertising use and that applicable local regulations or HOA rules permit commercial signage.
4.3 FenceSpace reserves the right to remove any listing that violates these Terms, contains illegal content, or is deemed inappropriate at our sole discretion.
5.1 Booking Process
Advertisers may submit booking requests for available fence spaces. Fence Owners must approve or decline requests within a reasonable timeframe. Both parties must agree to the terms of the booking before it is confirmed.
5.2 Payment Processing
All payments are processed through Stripe. By making or receiving payments on FenceSpace, you agree to Stripe’s Terms of Service and Privacy Policy. FenceSpace earns a commission on each successfully completed transaction. The applicable commission rate will be disclosed at the time of booking.
5.3 Cancellations and Refunds
Cancellation and refund policies are subject to agreement between the Fence Owner and Advertiser at the time of booking. FenceSpace will apply a platform-level cancellation policy where applicable. Disputes arising from cancellations must be raised within 7 days of the incident.
FenceSpace provides in-app messaging to facilitate communication between Fence Owners and Advertisers. All communications must remain respectful and professional. Users must not share personal contact information (email, phone number, social media handles) via messaging in an attempt to bypass the Platform. Violations may result in account suspension.
The FenceSpace community feed allows users to post updates, share experiences, follow other users, and interact through likes and comments. By posting content, you grant FenceSpace a non-exclusive, royalty-free, worldwide license to display, distribute, and promote your content within the Platform. You agree not to post:
FenceSpace reserves the right to remove any content and suspend users who violate community standards.
Both Fence Owners and Advertisers may rate and review each other after a completed booking. Reviews must be honest, fair, and based on actual experiences. FenceSpace reserves the right to remove reviews that are fraudulent, abusive, or violate these Terms. Attempts to manipulate ratings (e.g., incentivized reviews or fake accounts) will result in account termination.
You agree not to:
FenceSpace and its licensors own all rights, title, and interest in and to the Platform, including all software, design, trademarks, logos, and content created by FenceSpace. These Terms do not grant you any right to use FenceSpace’s intellectual property except as strictly necessary to use the Platform as intended. User-generated content (listings, posts, photos) remains the property of the user, subject to the license granted in Section 7.
FenceSpace is a marketplace platform and does not own, control, or guarantee the quality, safety, legality, or suitability of any fence listing. We do not endorse any user, listing, advertiser, or content on the Platform. The Platform is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the maximum extent permitted by applicable law, FenceSpace shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of the Platform. Our total liability to you for any claim arising under these Terms shall not exceed the total fees paid by you to FenceSpace in the twelve months preceding the claim.
You agree to indemnify, defend, and hold harmless FenceSpace, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected to your use of the Platform, your breach of these Terms, or your violation of any applicable law or third-party right.
FenceSpace reserves the right to suspend or terminate your account and access to the Platform at any time, with or without notice, for any reason, including breach of these Terms. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination (including Sections 10, 11, 12, and 13) will survive.
These Terms are governed by and construed in accordance with applicable law. Any disputes arising out of or related to these Terms or the Platform shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in accordance with applicable arbitration rules. You waive any right to participate in a class-action lawsuit or class-wide arbitration.
FenceSpace reserves the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms within the app and updating the “Last Updated” date. Your continued use of FenceSpace after changes are posted constitutes your acceptance of the revised Terms.
